In its judgement file ref. No. 29 ICdo 149/2025 dated 22 December 2025, the Czech Supreme Court ruled on the issue of jurisdiction in cases involving the cumulation of claims against the same defendant within a single action.
According to the Supreme Court’s legal opinion, where a claimant cumulates several claims against the same defendant within a single action, and some of those claims do not fall within the jurisdiction of the court of first instance before which the proceeding is conducted, the mere factual or legal “closeness” (connection) of such claims does not justify a breach of the constitutional right to a lawful judge. Thus, a court is not entitled to decide a claim over which it lacks jurisdiction even if such claim is asserted against the defendant jointly with another claim that is factually and legally related and over which the court of first instance has jurisdiction.
