In practice, it is fairly common that one of the parties to a sales contract about real estate listed in the Cadastral Register, is also subject to Art. 2 of Act No.340/2015 Coll., on the Contracts Register, as amended (the "Act").

If the contract must be recorded in the Contracts Register, then it will not take effect until the time of that registration under article 6 of the Act.

What does this mean in reality?

The Cadastral Office will examine whether a contract submitted with a registration application is already effective under article 17 para.1 of Act No. 256/2013 Coll., on the Cadastral Register. If the contract is not effective, the Cadastral Office will not complete the registration.

Since the Contracts Register only contains an electronic copy of the text of the contract without any signatures, electronic seals or time stamps (see article 1, para. 1 of the Act), the Cadastral Office cannot determine whether a contract is effective merely by looking at the Contracts Register.

Proof that a contract was recorded in the Contracts Register and has taken effect will instead take the form of the Interior Ministry confirmation sent to the databox of the person who filed for registration in the Contracts Register (see article 5 para.4 of the Act).

This confirmation and the contract should be attached to the registration application. If a hard copy of the contract is submitted, then the confirmation should be converted from e-format and also presented in hard copy.

The above rules apply from July 1, 2017.
